By this document, I, the undersigned, stating under oath that I have full legal and mental capacity to bind myself to the following terms, declare, acknowledge and commit to what is set out below.
1. Participant details
When you submit your registration, the site creates this letter as a PDF with your details already filled in. You write your official ID and your health insurance or NSS by hand on the printed copy.
2. Purpose of the activity
I state that, freely, voluntarily and with full information, I wish to take part in the activity known as Buffalo Mountain Sundance ("the activity"), organized by the Buffalo Mountain Sundance community at Rancho Las Maravillas ("the organizers").
The activity includes taking part as a dancer or as a supporter: sweat lodges (inipi), days of fasting, staying outdoors for the whole event, and support work such as tending the fire.
3. Acknowledgment and express assumption of risk
I acknowledge that the activity demands great physical, emotional and mental effort, and that it carries inherent, unforeseeable and unavoidable risks arising from its nature and from the conditions of the site.
I expressly accept that these risks include, without limitation: falls, accidents, dehydration, extreme fatigue, musculoskeletal injuries, illness, emotional distress, insect bites and stings, wildlife encounters, exposure to the elements, unexpected weather, damage to or loss of my belongings, and any other consequence that could affect my physical integrity or health, including death.
I understand the nature of these risks and I voluntarily, knowingly and exclusively assume all risks, known and unknown, and all consequences arising from my participation in the activity.
4. Camping and unsupervised time
I understand that the activity involves camping and long periods outdoors, and that there will be times, especially at night, when the organizers or their helpers are not present. The organizers are not responsible for incidents, injuries, emergencies, conflicts or loss of property during those periods, and I accept full responsibility for anything that happens to me during them.
5. Statement of fitness, health and substance use
I declare under oath that:
- I am in excellent physical, medical and mental health to take part in the activity.
- I do not suffer from heart disease, respiratory conditions, musculoskeletal injuries or any other medical condition, known or unknown, that limits, contraindicates or endangers my physical integrity or that of others during the event.
- I am not and will not be under the influence of alcohol, drugs, narcotics, psychotropic substances or medication that affects my motor skills, alertness or judgment.
- I have informed the organizers in writing and in good time of any daily medication I need to take, and of how to act in a medical emergency related to my health.
6. Acceptance of instructions and use of equipment
I agree to follow at all times the instructions, rules, safety protocols and guidelines of the organizers and of their staff, guides and helpers. I also agree to use the required protective equipment or supplies consistently and properly.
I know I can decide to stop taking part at any time. I also accept that the organizers may ask me to stop, and I agree to follow their instruction. Failing to follow these instructions entitles them to suspend or end my participation immediately, with no right to a refund or compensation of any kind.
7. Emergency medical authorization and costs
I understand that the organizers are not trained in medical diagnosis or treatment and do not provide medical or accident insurance.
If I have an accident, mishap or medical emergency during the activity, I authorize the organizers or their staff to notify my emergency contact immediately and, if needed, to request or arrange my transfer to the nearest medical or emergency center.
I accept that all medical, hospital, pharmacy, transport or other costs arising from that care are entirely my responsibility or that of my personal health insurance, and I release the organizers from paying any of them.
8. Care of the land and liability for damage
The activity takes place on private land: Rancho Las Maravillas, in Sultepec, State of Mexico. I agree to treat the land and its facilities with respect and care, and not to enter neighboring land without its owners' permission.
If I or a minor in my care damage the land, the facilities, the animals or other people's property, I accept full responsibility and will cover the cost of repairing it or returning it to its original condition.
9. Minors in my care
If I attend with children or other minors under my guardianship, what I declare and accept in this letter also applies to them, and I am responsible for their health, safety and actions throughout the activity.
10. Waiver and release of legal liability
Accordingly, on my own behalf and on behalf of my heirs, successors, executors or legal representatives, I release, discharge and exempt from all civil, criminal, administrative or any other liability the organizers and their helpers, guides, assistants and support staff.
I irrevocably waive any lawsuit, complaint, criminal charge, trial, administrative claim or action for compensation for property damage, medical costs, injury, losses or death arising from my participation in the activity, except where willful misconduct or gross negligence directly attributable to the organizers is proven in court.
